These Terms and Conditions apply to all services and products offered by Elena Botti, VAT IT01735400333, a freelance designer based in Italy, operating under the name “Elbo Atelier.”
By using this website or purchasing any service or product, you agree to the following Terms:
1. Services and Products
Elbo Atelier offers:
Custom design services
Digital and physical products sold via third-party platforms
All services are provided on a freelance, project-by-project basis.
2. Booking & Payments
To confirm a project, a non-refundable deposit is required.
Payment Structure:
Initial non-refundable deposit to reserve your slot
First installment before design work begins
Final installment before final delivery
Accepted payment methods: Bank Transfer (SEPA) or PayPal
Invoices are issued after the final payment.
3. Cancellations & Refunds
If a project is cancelled by the client, any completed work must be paid in full.
Deposits are non-refundable.
If Elbo Atelier cancels the project due to unforeseen circumstances, a proportional refund will be issued.
4. Delivery & Revisions
Timelines will be agreed in writing before the project begins.
Each design package includes up to 3 rounds of revisions.
Extra revisions or scope changes will be quoted separately.
5. Intellectual Property & Usage Rights
Upon full payment, the client is granted the right to use the final design materials for agreed commercial or personal use.
Elbo Atelier retains the right to showcase the work in portfolios, websites, and promotional materials.
6. Physical Products Fulfillment
For physical products sold via third-party platforms, fulfillment and delivery are handled by those providers.
Please refer to their policies for shipping, returns, and customer service.
7. Privacy & Data Use
We collect personal data such as name, email, and project details to deliver our services and communicate with you.
We use Google Analytics and similar tools to collect anonymous website usage data.
All personal data is handled in accordance with GDPR.

8. Limitation of Liability
Elbo Atelier is not liable for any indirect, incidental, or consequential damages. All deliverables are provided “as is.”
Clients are responsible for the correct use and implementation of the final materials.
9. Governing Law & Language
These Terms are governed by the laws of Italy. Any disputes will be handled by the courts of Italy.
These Terms are provided in English. An Italian translation can be provided upon request. In case of discrepancies, the English version prevails.
10. Tax Responsibility (for international clients)
Clients are responsible for complying with their local tax regulations, including any VAT obligations that may apply in their country.
